Terms of Service

1. The Company and Platform

1.1 Operator. Married By Design is owned and operated by LiZug LLC, a Rhode Island limited liability company ("Company," "we," "us," or "our").

1.2 Platform Description. Married By Design is an AI-assisted relationship coaching platform for married couples. The platform provides structured self-reflection questionnaires, AI-generated relationship profiles, Couple Maps, homework programs, and optional human coaching sessions. It is not a therapy, counseling, or mental health treatment service.

1.3 Not Therapy. THE MARRIED BY DESIGN PLATFORM IS NOT A SUBSTITUTE FOR PROFESSIONAL MENTAL HEALTH TREATMENT, THERAPY, COUNSELING, OR MEDICAL CARE. If you or your partner are experiencing a mental health crisis, domestic violence, suicidal ideation, substance abuse, trauma, or any condition requiring clinical intervention, please contact a qualified licensed professional immediately. 2. Eligibility

2.1 Age Requirement. You must be at least 18 years of age to use the platform.

2.2 Marital Status. The platform is designed for married couples. By creating an account, you represent that you are currently legally married.

2.3 Legal Capacity. You represent that you have the legal capacity to enter into a binding agreement and are not prohibited from doing so under applicable law.

2.4 Geographic Scope. The platform is operated from the United States and is intended for use by couples worldwide, subject to applicable local laws. By using the platform, you represent that your use complies with all laws applicable in your jurisdiction.

3. Accounts and Registration

3.1 Account Creation. Each partner creates their own individual account. You agree to provide accurate, complete, and current information during registration.

3.2 Account Security. You are responsible for maintaining the confidentiality of your password and for all activity that occurs under your account. Notify LiZug LLC immediately at admin@marriedbydesign.com of any unauthorized use.

3.3 One Account Per Person. You may not create more than one account or create an account on behalf of another person without their explicit consent.

3.4 Account Linking. By inviting your spouse and accepting an invitation, you consent to your accounts being linked as a couple on the platform, with the data-sharing implications described in the Privacy Policy.

4. Platform Access and Subscriptions

4.1 Paid Access. Access to the platform's core features (Couple Map, homework program, coaching) requires a paid subscription or program purchase.

4.2 Program Pricing. DIY program pricing is based on the AI-recommended program length, charged as a one-time total fee. Coaching subscriptions are billed monthly on a recurring basis.

4.3 Auto-Renewal. Monthly coaching subscriptions auto-renew automatically unless canceled by the Client prior to the renewal date. By subscribing, you authorize LiZug LLC to charge your payment method on a recurring basis.

4.4 Failed Payment. If a payment fails, access to the platform will be suspended until payment is successfully processed. LiZug LLC will notify you via email of failed payments.

4.5 Cancellation. You may cancel your subscription at any time through your account settings or by contacting admin@marriedbydesign.com. Cancellation takes effect at the end of the current billing period. No prorated refunds will be issued for unused time within a paid period.

4.6 No Refunds. ALL FEES PAID TO LIZUG LLC ARE NON-REFUNDABLE, except as expressly provided in the Coaching Agreement for Company-initiated termination of coaching services. This no-refund policy applies to DIY program purchases and coaching subscriptions alike.

4.7 Price Changes. LiZug LLC reserves the right to change pricing at any time. Price changes will be communicated with reasonable notice and will not affect the current paid period for existing subscribers.

5. Acceptable Use

5.1 Permitted Use. You may use the platform solely for your own personal, non-commercial use as a married couple seeking relationship support.

5.2 Prohibited Conduct. You agree not to: (a) use the platform for any unlawful purpose; (b) submit false, misleading, or fraudulent information; (c) attempt to access another couple's data; (d) reverse engineer, decompile, or attempt to extract the source code of the platform; (e) use automated tools to access or scrape the platform; (f) resell, sublicense, or commercially exploit any platform content; (g) interfere with the platform's security or integrity; (h) impersonate any person or entity; or (i) use the platform in any way that could harm LiZug LLC or other users.

5.3 Consequences of Violation. LiZug LLC reserves the right to terminate your account immediately and without notice for any violation of these Terms.

6. AI-Generated Content

6.1 Nature of AI Content. The platform uses artificial intelligence to generate relationship profiles, Couple Maps, homework programs, and coaching plans based on your questionnaire responses. This content is generated algorithmically and does not constitute professional advice, clinical evaluation, or therapeutic treatment.

6.2 No Accuracy Guarantee. LiZug LLC does not warrant the accuracy, completeness, or suitability of any AI-generated content for any particular purpose. AI-generated content is provided for informational and coaching support purposes only.

6.3 Human Review. AI-generated content may be reviewed by LiZug LLC staff and coaches for quality assurance and coaching purposes.

6.4 Intellectual Property. All AI-generated content is the sole and exclusive intellectual property of LiZug LLC. See Section 9 for details.

7. Sensitive Data

7.1 Nature of Data Collected. The platform collects sensitive personal information including relationship dynamics, conflict patterns, emotional intimacy, stress responses, and family systems data. By using the platform, you consent to the collection and processing of this data as described in the Privacy Policy and Consent for Data Processing.

7.2 Data Security. LiZug LLC implements reasonable security measures to protect your data. However, no internet transmission is 100% secure, and LiZug LLC cannot guarantee absolute security.

8. Third-Party Services

8.1 Payment Processing. Payments are processed by Stripe, Inc. Your payment information is subject to Stripe's privacy policy and terms of service. LiZug LLC does not store full payment card information.

8.2 Email Delivery. Transactional emails are delivered via Mailjet. Your email address may be processed by Mailjet in accordance with their privacy policy.

8.3 AI Processing. Questionnaire data is processed by Google's Gemini AI via Lovable's AI Gateway. Data processing is subject to applicable data processing agreements.

8.4 No Endorsement. LiZug LLC is not responsible for the practices or content of any third-party services.

9. Intellectual Property

9.1 Platform Ownership. The Married By Design platform, including all software, design, AI systems, content, trademarks, and trade dress, is the exclusive property of LiZug LLC and is protected by applicable intellectual property laws.

9.2 AI-Generated Content Ownership. All AI-generated content produced by the platform, including but not limited to individual profiles, Couple Maps, homework programs, coaching plans, and session content, is the sole and exclusive intellectual property of LiZug LLC.

9.3 Limited License. LiZug LLC grants you a limited, non-exclusive, non-transferable, revocable license to access and use the platform and its generated content solely for your personal use during the term of your active subscription or program access period.

9.4 User Content. By submitting questionnaire responses and other content to the platform, you grant LiZug LLC a perpetual, worldwide, royalty-free license to use, process, and analyze such content for the purpose of providing and improving the platform's services, in accordance with the Privacy Policy.

9.5 Feedback. If you provide feedback or suggestions about the platform, you grant LiZug LLC the right to use such feedback without restriction or compensation to you.

10. Disclaimers

10.1 AS-IS BASIS. THE PLATFORM AND ALL CONTENT ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR UNINTERRUPTED SERVICE.

10.2 No Relationship Guarantee. LIZUG LLC MAKES NO WARRANTY OR REPRESENTATION THAT USE OF THE PLATFORM WILL IMPROVE, SAVE, OR REPAIR ANY MARRIAGE OR RELATIONSHIP.

10.3 Availability. LiZug LLC does not warrant that the platform will be available at all times or free from errors, bugs, or interruptions.

11. Limitation of Liability

11.1 Exclusion of Damages. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, LIZUG LLC, ITS MEMBERS, MANAGERS, EMPLOYEES, COACHES, AGENTS, AND SUCCESSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR RELATIONSHIP BREAKDOWN, EMOTIONAL DISTRESS, LOSS OF CONSORTIUM, LOSS OF INCOME, OR ANY OTHER INTANGIBLE LOSSES.

11.2 Liability Cap. IN NO EVENT SHALL LIZUG LLC'S TOTAL LIABILITY TO YOU EXCEED THE TOTAL AMOUNT YOU PAID TO LIZUG LLC IN THE THIRTY (30) DAYS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

11.3 Essential Basis. These limitations reflect a reasonable allocation of risk and are an essential element of the basis of the bargain between the parties.

12. Indemnification

You agree to indemnify, defend, and hold harmless LiZug LLC, its members, managers, employees, coaches, agents, successors, and assigns from and against any and all claims, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the platform; (b) your breach of these Terms; (c) any misrepresentation made by you; (d) any claim arising from your relationship or actions toward your partner; or (e) your violation of any applicable law.

13. Dispute Resolution

13.1 Informal Resolution. Before initiating any formal dispute, you agree to contact LiZug LLC at admin@marriedbydesign.com and attempt informal resolution for 30 days.

13.2 Binding Arbitration. Any unresolved dispute shall be resolved by binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules in Providence, Rhode Island, or remotely if agreed.

13.3 Class Action Waiver. YOU WAIVE ANY RIGHT TO PARTICIPATE IN A CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION AGAINST LIZUG LLC.

13.4 Jury Trial Waiver. TO THE EXTENT PERMITTED BY LAW, BOTH PARTIES WAIVE ANY RIGHT TO A JURY TRIAL.

13.5 Exception. Either party may seek emergency injunctive relief from a court in Providence County, Rhode Island.

14. Termination

14.1 By You. You may terminate your account at any time by contacting admin@marriedbydesign.com. Termination does not entitle you to any refund.

14.2 By LiZug LLC. LiZug LLC may suspend or terminate your account immediately and without notice for any violation of these Terms, fraudulent activity, or for any other reason at its sole discretion.

14.3 Effect of Termination. Upon termination, your license to use the platform ceases immediately. Sections 6.4, 9, 10, 11, 12, 13, and 15 survive termination.

15. General Provisions

15.1 Governing Law. These Terms are governed by the laws of the State of Rhode Island.

15.2 Entire Agreement. These Terms, together with the Privacy Policy, Consent for Data Processing, and Coaching Agreement (if applicable), constitute the entire agreement between you and LiZug LLC.

15.3 Severability. If any provision is found unenforceable, the remaining provisions remain in full force.

15.4 Waiver. Failure to enforce any provision does not constitute a waiver.

15.5 Amendment. LiZug LLC may update these Terms at any time. Continued use after notice constitutes acceptance.

15.6 Assignment. LiZug LLC may assign these Terms without consent. You may not assign without LiZug LLC's written consent.

15.7 Force Majeure. LiZug LLC is not liable for delays or failures due to circumstances beyond its reasonable control.

15.8 Electronic Agreement. Your acceptance of these Terms via checkbox constitutes a legally binding electronic signature under the E-SIGN Act and UETA as adopted in Rhode Island.
